Can foreign nationals purchase and own residential property in Vietnam?

The answer is yes. Foreigners are fully entitled to own housing in Vietnam

However, this privilege does not extend to every type of real estate. Foreign individuals seeking property ownership must satisfy specific legal requirements and eligibility criteria set forth by Vietnamese law.

This article provides a clear, comprehensive breakdown of who qualifies to purchase property in Vietnam, the eligible property types, ownership duration, leasing and transfer rights, as well as key considerations to keep in mind before making an investment decision.

1. Are foreigners allowed to buy houses in Vietnam?

Prior to 2015, foreign homeownership in Vietnam was tightly restricted, limited to a very small group of special categories with stringent requirements.

Since the introduction of the Housing Law 2014—and now reinforced and expanded under the Housing Law 2023—the legal framework governing foreign property ownership in Vietnam has become significantly clearer, more transparent, and remarkably welcoming.

Under the Housing Law 2023, the foreign entities and individuals permitted to own housing in Vietnam include:

– Foreign-invested organizations developing housing construction projects in Vietnam.

– Foreign-invested economic organizations, branches, representative offices of foreign companies, foreign investment funds, and foreign bank branches operating legally in Vietnam.

– Foreign individuals who are permitted to enter Vietnam. There is no requirement for permanent residency—as long as entry is legal and the individual does not enjoy diplomatic or consular privileges and immunities.

So, The answer is YES Foreigners are fully permitted to purchase and own commercial housing within approved residential projects in Vietnam. However, the scope, ownership forms, and tenure are subject to specific limits compared to Vietnamese citizens. This regulatory approach is designed to strike a balanced harmony: welcoming foreign investment while safeguarding national security, defense, and strategic land management.

According to Vietnamese law, foreign ownership does not apply to all property types across the board. Instead, foreigners and entities are permitted to purchase specific categories of commercial residential projects, excluding areas restricted for national defense and security purposes.

2.1. Commercial Apartments / Condominiums — PERMITTED

Commercial apartments represent the most accessible and popular property type for foreign buyers in Vietnam.

Key requirements include:

– The property must belong to an approved commercial housing project permitted by competent state authorities for sale to foreign buyers.

– The project must have remaining foreign ownership quota. Specifically, the total number of apartments owned by foreign individuals and organizations within a single condominium building cannot exceed 30% of the total units..

2.2. Landed Property Within Commercial Projects – PERMITTED

Foreigners can also own landed properties such as townhouses or villas, provided they meet strict project-based criteria

Key requirements include:

– The property must be located within a planned commercial housing development built in compliance with legal standards.

–The project must be officially cleared by government authorities for foreign ownership.

– The project must be within the prescribed foreign quota limits: foreign ownership cannot exceed 10% of the total landed units in a single project,, or a maximum of 250 landed homes within an entire ward-level administrative area.

2.3. Commercial & Service Properties — LONG-TERM LEASE AGREEMENT

For commercial and service-oriented properties such as condotels, officetels, or shophouses designated for commercial use, foreign individuals are permitted to sign long-term lease contracts to operate them according to their intended functions. These property types are not eligible for Ownership Certificates issued to foreign individuals under residential purchase agreements.

2.4. Ineligible Property Types — NOT PERMITTED FOR PURCHASE

To mitigate legal risks, foreigners need to be aware of the types of assets they are not entitled to own in Vietnam:

- Townhouses and Individual Villas Outside Projects: Residential properties located in traditional alleys or standard streets—traded directly between private individuals outside planned commercial developments—are strictly off-limits to foreign buyers.

- Individual Land Plots: Foreigners are not entitled to receive transfers of land-use rights for individual land plots in Vietnam.

3. Housing Ownership Duration for Foreigners in Vietnam

As a general rule, foreigners are granted housing ownership in Vietnam for maximum 50 years starting from the issuance date of the Ownership Certificate (Pink Book). Upon expiration, owners may apply for a lease extension, subject to satisfying the legal regulations in effect at that time.

- Commercial Apartments: The ownership term is 50 years from the date the Certificate is issued.

- Low-Rise Residential Properties within Commercial Projects: The ownership term is 50 years from the date the Certificate is issued.

- Commercial and Service Properties (Condotels, Officetels, Shophouses): The ownership or usage duration is typically aligned with the land-use term or the remaining lifecycle of the investment project. This duration is explicitly stated in the Ownership Certificate or the project's legal dossier.

4. Can Foreigners Lease or Transfer Their Purchased Properties?

The answer is yes. Once foreigners legally acquire housing in Vietnam, they enjoy full rights to utilize and dispose of their real estate asset. This includes leasing the property to generate rental income, transferring ownership when needed, gifting, passing it down as an inheritance, or authorizing a third party for management.

However, these transactions must comply with applicable laws and regulations, just like those conducted by Vietnamese citizens.

For example, when leasing, property owners must fulfill their applicable tax obligations and complete the relevant procedures as required by law. In the case of resale, gifting, or inheritance, the recipient must also be eligible to own housing in Vietnam. If the recipient does not meet the legal requirements to hold title to the property, they are entitled to receive only the monetary value of the asset as prescribed by law.

5. Who Can Foreign Owners Transfer Their Properties To?

Foreign individuals legally owning residential property in Vietnam may transfer their ownership title to:

– Vietnamese citizens.

– Vietnamese citizens residing abroad who are eligible to own housing in Vietnam.

– Other foreign individuals, provided the buyer meets ownership eligibility requirements and the project maintains available foreign quota.

– Foreign organizations legally operating in Vietnam, provided that they meet the eligibility requirements for ownership and the project has remaining foreign ownership quota.
